Terms & Conditions

  • What do these Terms cover?

    They apply to short- and longer-term stays with FERDI, whether booked directly through FERDI/Uplisting or via platforms such as Airbnb, Booking.com or other authorised partners. Booking-specific and platform terms may also apply.

  • What are the main guest responsibilities?

    Guests must respect the apartment, neighbours and house rules, keep access codes secure, register all overnight guests, and cover reasonable costs for damage, missing items or excessive cleaning caused during their stay.

  • How do payments, cancellations and deposits work?

    The price, payment schedule, cancellation policy and any security deposit are those shown and accepted for the specific booking. For third-party bookings, the relevant platform’s payment and cancellation rules may apply.

  • What else should guests know?

    FERDI may require guest registration and identity verification before check-in. Stays are governed by Austrian law, and any mandatory consumer or tenancy rights that apply to a particular booking remain unaffected.

These Terms & Conditions (“Terms”) apply to bookings and stays with FERDI and to the use of the website ferdi.love, ferdistays.com and FERDI’s direct booking services.


1. Operator

Hereinafter referred to as “FERDI”, “we”, “us” or “Host”.


2. Scope


These Terms apply to accommodation booked directly with FERDI, including through ferdi.love, booking.ferdi.love, ferdistays.com or another direct booking channel operated by FERDI.


Where a booking is made through a third-party platform such as Airbnb or Booking.com, the terms, payment conditions and cancellation policy of that platform may additionally apply and, in relation to matters governed by the platform, take precedence.


Individual terms stated in a booking offer or booking confirmation take precedence over these general Terms in the event of a conflict.


3. Nature of the Accommodation


FERDI provides fully furnished apartments for temporary accommodation.


A booking constitutes a short-term accommodation agreement (Beherbergungsvertrag) and does not establish a residential tenancy or permanent right of residence.


The apartment may not be used as the Guest’s permanent residence or registered as a Hauptwohnsitz unless FERDI has expressly agreed otherwise in writing.


4. Booking and Formation of Contract


A booking becomes binding when it is confirmed through the relevant booking system, website or booking platform.

By completing a booking, the person making the reservation confirms that:


  • the information provided is accurate and complete;
  • they are legally entitled to enter into the booking;
  • they accept these Terms and any conditions shown during the booking process; and
  • where booking on behalf of other guests, they will ensure that those guests comply with the applicable conditions and house rules.


The accommodation, dates, number of guests, price and other booking-specific conditions are stated in the booking confirmation.


5. Prices, Taxes and Charges


The applicable accommodation price is the price displayed and accepted at the time of booking.


Unless otherwise stated, the booking price includes the accommodation and ordinary use of utilities including electricity, heating, water and internet access.


Local taxes, tourism taxes, city taxes or similar statutory charges may be added where applicable.


Optional services and additional charges are displayed during the booking process or communicated separately before they are incurred.


6. Payment


Payment is processed through the payment method and payment provider made available during the booking process.


For bookings made through third-party booking platforms, payment is governed by the conditions of the relevant platform.


For direct bookings, the applicable payment schedule and conditions are displayed during booking or stated in the booking confirmation.


Where required, FERDI or its payment provider may request a payment-card authorisation or security deposit.


If a required payment or payment authorisation cannot be completed, FERDI may cancel the reservation in accordance with the applicable booking conditions.


7. Security Deposits, Damages and Additional Charges


FERDI may require a security deposit or payment-card authorisation in connection with a reservation.


Guests are responsible for damage or loss caused by themselves, members of their group or their visitors during the stay.


FERDI may charge reasonable and documented costs arising from, among other things:


  • damage to the apartment, building, furniture, fixtures or equipment;
  • missing or damaged items;
  • damage to common areas;
  • excessive cleaning beyond normal accommodation turnover;
  • smoking or unauthorised parties;
  • lost keys or access devices;
  • lockouts caused by the Guest;
  • misuse of access systems; and
  • costs or fines attributable to a Guest’s violation of applicable house rules.


Any charge will reflect the reasonable cost of repair, replacement, cleaning or restoration.


Guests should report damage or defects as soon as reasonably possible.


8. Guest Registration and Identity Verification


Guests may be required to provide information necessary to comply with Austrian registration, tourism, security and other applicable legal requirements.


FERDI may also require the primary Guest and, where appropriate, additional guests to complete an identity verification process before check-in.


This may include providing information from or a copy/image of a valid government-issued identification document through FERDI’s guest-management or verification system.


Where identity verification or legally required guest registration has not been completed within the requested period, FERDI may be unable to provide access to the accommodation.


9. Self Check-In


FERDI apartments may operate using self check-in.


Access instructions, digital keys, PIN codes or other access credentials are generally provided before arrival after all required booking, payment, registration and verification steps have been completed.


Guests must:


  • keep access credentials confidential;
  • not provide access credentials to unauthorised persons;
  • use access systems responsibly; and
  • ensure apartment and building doors are properly secured.


FERDI may deactivate or replace access credentials where reasonably necessary for security purposes.


10. Check-In and Check-Out


The applicable check-in and check-out times are shown in the booking confirmation.


Early check-in and late check-out are subject to availability and may incur an additional charge.


Guests must vacate the apartment by the agreed check-out time unless a late check-out has been confirmed by FERDI.


11. Number of Guests


Only the number of guests stated in the reservation may stay overnight in the apartment.


Guests may not:


  • sublet the apartment;
  • transfer the reservation without FERDI’s permission;
  • permit unregistered persons to stay overnight; or
  • exceed the maximum permitted occupancy.


FERDI may refuse or terminate accommodation where occupancy limits are materially exceeded or an apartment is being used contrary to the booking.


12. House Rules


Guests must behave considerately toward neighbours, other guests and building occupants.


Unless otherwise stated for a particular property:


  • parties, events and disruptive gatherings are prohibited;
  • smoking is prohibited inside apartments;
  • quiet hours must be respected, generally between 22:00 and 07:00;
  • pets are permitted only where allowed by the applicable property conditions or with prior approval;
  • illegal activities are prohibited; and
  • building and property-specific rules must be observed.


Serious or repeated violations may result in termination of the stay where legally permissible, particularly where necessary to protect other guests, neighbours, the property or building occupants.


13. Permitted Use


FERDI accommodation is provided exclusively for temporary accommodation.


Without FERDI’s prior written approval, apartments may not be used for:


  • events or parties;
  • commercial activities involving customers or visitors;
  • business or company registrations;
  • permanent residence; or
  • illegal activities.


14. Condition of the Apartment and Cleaning


FERDI apartments are professionally prepared before arrival.


Guests are expected to treat the apartment with reasonable care and, on departure:


  • dispose of waste appropriately;
  • wash or place used dishes in the dishwasher where available; and
  • leave the apartment in a reasonably tidy condition.


Normal turnover cleaning is included where specified in the booking. Additional cleaning costs may be charged where cleaning materially beyond normal use is required.


15. Cancellation and No-Shows


The cancellation conditions applicable to a reservation are those displayed and accepted during the booking process.


For bookings made through third-party platforms, cancellations and refunds are governed by the conditions applicable to the reservation on that platform.


For direct bookings, the cancellation policy displayed during checkout and included in the booking confirmation applies.


Failure to arrive does not automatically entitle the Guest to a refund.


Any mandatory statutory consumer rights remain unaffected.


16. Changes or Unavailability


If FERDI is unable to provide the booked apartment due to circumstances such as significant damage, technical failure, safety concerns or another circumstance making accommodation impossible or unreasonable, FERDI will seek an appropriate solution.


Depending on the circumstances, this may include offering comparable alternative accommodation, changing the booking dates by agreement, or refunding amounts paid for accommodation that FERDI cannot provide.


Mandatory statutory rights remain unaffected.


17. Guest Responsibilities


Guests must use the apartment, furnishings, appliances and access systems with reasonable care.


Guests must promptly notify FERDI of significant defects, damage, safety concerns or technical problems so that FERDI has a reasonable opportunity to address them.


Guests are responsible for the conduct of persons accompanying them and visitors admitted by them to the extent provided by applicable law.


18. Liability


FERDI is liable in accordance with applicable Austrian law.


Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory liability for intentional misconduct or personal injury where applicable.


FERDI is not responsible for loss, damage or disruption caused by circumstances outside its reasonable control except to the extent FERDI is legally liable.


Guests are responsible for taking reasonable care of their personal belongings.


Temporary interruptions to internet access, utilities or building services do not automatically give rise to compensation where the interruption is outside FERDI’s reasonable control and FERDI takes reasonable steps to address the issue.


19. Website


The information on ferdi.love and ferdistays.com is provided with reasonable care. Images, floor plans, descriptions and other presentation materials are intended to give a representative impression of the accommodation.


Minor differences that do not materially affect the booked accommodation may occur.


FERDI may update, modify or temporarily restrict website functionality where reasonably necessary.


20. Intellectual Property


Unless otherwise stated, the content of ferdi.love and ferdistays.com—including FERDI branding, text, graphics, photographs and design elements—is owned by FERDI or used with permission.


Content may not be reproduced, commercially exploited or distributed without the relevant rights holder’s permission except where permitted by law.


21. Data Protection


Personal data is processed in accordance with applicable data-protection law, including the EU General Data Protection Regulation (GDPR).

22. Communication


Guests agree that booking-related communications may be sent electronically, including by email, SMS, messaging services or through the relevant booking platform where appropriate.


Guests are responsible for providing accurate contact details and monitoring booking-related communications before and during their stay.


23. Applicable Law and Jurisdiction


These Terms and accommodation agreements with FERDI are governed by Austrian law, subject to mandatory consumer-protection provisions that may apply to Guests resident in another jurisdiction.


Where legally permissible, Vienna, Austria shall be the place of jurisdiction.


Mandatory statutory jurisdiction rules for consumers remain unaffected.


24. Severability


If an individual provision of these Terms is invalid or unenforceable, the validity of the remaining provisions is unaffected to the extent permitted by law.
